PECA 2016 (s.20) — The lever

For fake and competitor reviews we add the Prevention of Electronic Crimes Act 2016 — s.20 protects the dignity of a natural person against unlawful online content, targeting anonymous and manipulative reviews.

Consumer Protection & Article 14 — The amplifier

We apply the provincial Consumer Protection Acts against misleading claims and press Google on privacy grounds — protected under Article 14 of the Constitution and via PECA, since a comprehensive data-protection law is still pending — combining all three foundations into one argument.

What legal grounds do you act on?
Primarily defamation — the Defamation Ordinance 2002 and the tort of defamation, where a review damages your reputation through false statements.
